Terms of Service

Welcome to Nouri. These Terms of Service ("Terms") govern your use of the Nouri mobile application (the "App"), provided by Jacks Labs LLC ("we," "us," or "our"). By creating an account or using the App, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Nouri. If you are under the age of majority in your country, you may only use Nouri with the involvement of a parent or guardian.

2. Your Account

You are responsible for the information you provide and for any activity that happens under your account. You agree to:

• Provide accurate information during onboarding and account creation.
• Keep your login credentials secure.
• Notify us at support@nouriapp.co if you believe your account has been accessed without your permission.

3. Subscriptions, Trials, and Billing

Nouri offers paid subscriptions, including a yearly plan at $79.99/year (with a 3-day free trial for new users) and a monthly plan at $9.99/month.

• All payments are processed by Apple through the App Store. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel your subscription at any time through your Apple ID account settings.
• Free trials automatically convert to paid subscriptions unless cancelled before the trial ends.
• Refunds are handled exclusively by Apple under their standard policies.
• We may change subscription pricing in the future. You will be notified before any change affects you.

4. Acceptable Use

When using Nouri, you agree NOT to:

• Use the App for any illegal purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or extract source code from the App.
• Use the App to harass, harm, or impersonate others.
• Submit content that is misleading, abusive, or designed to disrupt the App's functionality.
• Use automated systems, bots, or scripts to interact with the App.
• Resell, sublicense, or otherwise commercialize the App without our written permission.

5. Health and Nutrition Disclaimer

Nouri provides nutritional estimates and goal-tracking tools for informational and educational purposes only. The information provided:

• Is not a substitute for professional medical, nutritional, or fitness advice.
• Should not be used to diagnose, treat, cure, or prevent any health condition.
• May not be accurate in every case, as AI-generated estimates have natural variation.

Always consult a qualified healthcare provider or registered dietitian before making significant dietary changes, especially if you have a medical condition, are pregnant, are breastfeeding, or are managing a health concern.

6. AI-Generated Content

Nouri uses artificial intelligence to estimate the nutritional content of foods you log. These estimates are based on best-effort interpretation and may not match laboratory analysis. By using Nouri, you acknowledge that:

• AI-generated estimates are inherently approximate.
• You are responsible for verifying nutritional information that matters to your health.
• We are not liable for decisions made based on AI-generated estimates.

7. Intellectual Property

The App, including its design, code, content, and branding, is owned by Jacks Labs LLC and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial use.

You retain ownership of the content you create within the App (such as food log entries and notes). By submitting that content, you grant us permission to process it as needed to provide the App's functionality.

8. Privacy

Your use of Nouri is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

9. Termination

You may delete your account at any time from within the App. We may suspend or terminate your account if you violate these Terms or engage in conduct that harms the App or other users. Upon termination, your right to use the App ends immediately, and your data may be deleted in accordance with our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law:

• Nouri is provided "as is" and "as available," without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total liability for any claim arising from these Terms or your use of the App is limited to the greater of $50 USD or the amount you paid us in the 12 months preceding the claim.

11. Changes to These Terms

We may update these Terms from time to time. Significant changes will be communicated through the App or via email. Continued use of Nouri after the changes take effect indicates your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of laws principles. Any disputes arising from these Terms will be resolved in the state or federal courts located in Miami-Dade County, Florida.
